Welcome to Byte Core Solutions Limited (“Byte Core”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our services, including but not limited to software development, IT solutions, and cloud services (collectively, the “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms.

Eligibility

You must be at least 18 years old or have the legal capacity to enter into a binding agreement in your jurisdiction. By using our Services, you represent and warrant that you meet these requirements.

Use of Services

You agree to use our Services only for lawful purposes and in a manner consistent with all applicable laws and regulations. You may not misuse the Services or interfere with their normal operation or security.

Account Registration

To access certain Services, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Service Availability

While we strive to ensure our Services are available at all times, we do not guarantee uninterrupted or error-free performance. Services may be interrupted for maintenance, upgrades, or due to circumstances beyond our control.

Fees and Payments

All fees, including one-time charges and subscription fees, are clearly indicated during the service ordering process. You agree to pay all applicable charges associated with your use of our Services, including:

• Recurring subscription fees for ongoing services,
• Usage-based charges where applicable.

All payments are due in advance unless otherwise agreed in writing. Pricing is subject to change, but you will be notified in advance of any modifications that affect your active services. Failure to make timely payments may result in suspension or termination of Services.

Payment Authorization

By providing your payment information to Byte Core, you authorize us to charge the designated payment method for any purchases or subscription fees incurred. You affirm that you are an authorized user of the card or account and that you will not dispute the charges with your financial institution, provided the transactions correspond to the terms indicated in this agreement.

For recurring or subscription payments, you authorize Byte Core to automatically charge your payment method on a recurring basis until the service is canceled in accordance with our cancellation policy. Byte Core reserves the right to suspend or terminate access to Services if any payment is reversed or disputed without prior communication and resolution attempts.

Subscription & Cancellation Policy

If you subscribe to a recurring service, you may cancel by providing written notice at least 7 days before the next billing cycle. Cancellations are effective at the end of the current billing period. No refunds are provided for unused portions of a billing cycle once invoiced.

Intellectual Property

All content, technology, branding, and documentation provided by Byte Core remain the intellectual property of Byte Core Solutions Limited. You may not reproduce, resell, or reverse-engineer any part of our Services without express written permission.

Data Protection and Privacy

Use of our Services is also governed by our Privacy Policy, which outlines how we collect, store, and use personal and business data.

Limitation of Liability

To the fullest extent permitted by law, Byte Core shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data arising out of or in connection with your use of the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Byte Core, its affiliates, officers, and employees from and against any claims, liabilities, damages, and expenses arising out of your violation of these Terms or misuse of the Services.

Termination

We may suspend or terminate your access to our Services at any time for breach of these Terms or for any other reason deemed appropriate. You may also terminate your use of the Services by notifying us in writing.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.

Amendments

We may modify or update these Terms from time to time. Continued use of the Services after any changes constitutes your acceptance of the new Terms.
